Recovery Rides LLC ("Recovery Rides," "we," "us," or "our") is committed to safeguarding the privacy and data of its users. This Privacy Policy explains how we collect, use, share, and protect information through our website, mobile applications, services, and communications.

By using any part of the Recovery Rides platform, including the Recovery Rides Driver App or Customer App, you consent to the collection and use of your information as described in this policy.

2. INFORMATION WE COLLECT

2.1 Personal Information

  • Government-issued ID (for driver onboarding)
  • Insurance, vehicle, and background check data (drivers only)

3. HOW WE USE YOUR INFORMATION

4. SHARING OF INFORMATION

We may share your data under the following circumstances:

  • With Service Providers and Vendors: Including Stripe, background check agencies (e.g., Checkr), customer support tools, cloud hosting platforms, and analytics providers. These third parties only receive information necessary to perform their services and are bound by confidentiality obligations.
  • With Drivers or Riders: Limited data such as name, pickup/drop-off information, and contact number may be shared to facilitate ride fulfillment and safety during active transportation.
  • With Law Enforcement or Legal Entities: When required to comply with legal obligations, court orders, subpoenas, or to protect the rights, safety, or property of Recovery Rides, its users, or others.
  • During a Business Transfer: If Recovery Rides is involved in a merger, acquisition, asset sale, bankruptcy, or reorganization, your data may be transferred as part of that transaction, subject to standard confidentiality protections.
  • With Affiliates and Partners: Internal corporate affiliates and recovery-focused partners may receive anonymized or aggregated data for analytics, program development, and strategic operations.
  • With Your Consent: Any other sharing not covered above will only occur with your explicit, informed consent.

We do not sell, lease, or rent your personal data to third parties for marketing or advertising purposes.

5. DATA RETENTION AND USER RIGHTS

We retain user data for as long as necessary to fulfill the purposes described in this Privacy Policy, comply with legal requirements, resolve disputes, and enforce our agreements.

Users may request access to, a copy of, or deletion of their personal information by emailing support@recoveryrides.com. We will process such requests in accordance with applicable laws. Data deletion requests may result in limited or terminated access to the Recovery Rides platform.

6. COMMUNICATION CONSENT

By downloading or using either the Recovery Rides Driver App or Customer App, you explicitly agree to receive communication via:

  • Push notifications
  • Phone calls

This includes messages regarding account activity, ride details, app updates, marketing, promotional offers, legal disclosures, and service announcements.

You may opt out of marketing messages at any time, but operational and transactional communications will continue as long as your account is active.

7. SECURITY MEASURES

We implement industry-standard security protocols, including:

  • Data encryption (in transit and at rest)
  • Multi-factor authentication
  • Access control
  • Secure servers and data storage

Despite our efforts, no method of transmission is 100% secure. Users assume some risk when submitting data online.

8. CHILDREN’S PRIVACY

Our services are not intended for use by individuals under the age of 18 without guardian supervision. We do not knowingly collect information from minors. If we discover such data has been collected, we will delete it and, if necessary, report it to the appropriate federal, state, or local agencies as required by law.

Users are responsible for reviewing the policy periodically for updates. Continued use of the platform after any changes are posted constitutes acceptance of the updated terms.

10. GOVERNING LAW AND DISPUTE RESOLUTION

All matters arising from or related to this Privacy Policy, including any disputes regarding data use, consent, platform access, or security, shall be governed by the laws of the State of Delaware.

By using the Recovery Rides platform, you agree that any and all litigation, claims, or arbitration proceedings shall be exclusively resolved in the Delaware Court of Chancery. If necessary, cases may be escalated to the Superior Courts of Delaware as dictated by legal procedure or jurisdiction.

Recovery Rides and its users waive any right to a jury trial and agree to resolve claims in a streamlined and legally binding manner in accordance with applicable Delaware state law.

RECOVERY RIDES DRIVER TERMS OF SERVICE AND OPERATING POLICY

SECTION A: ZERO TOLERANCE POLICY

Recovery Rides maintains a strict Zero Tolerance Policy to protect the safety, dignity, and well-being of all riders, facilities, and drivers. This policy is mandatory and non-negotiable. All drivers agree to adhere to the following:

A.1 Substance Use and Impairment

  1. Drivers must never operate a vehicle under the influence of alcohol, illegal drugs, marijuana (regardless of state legality), or prescription medication that impairs their ability to drive.
  2. Any suspicion, report, or evidence of impaired driving will result in immediate removal from the platform and permanent disqualification.

A.2 Harassment, Abuse, and Discrimination

  1. Disrespectful, abusive, discriminatory, or aggressive language or behavior toward any rider, facility staff, or Recovery Rides personnel will not be tolerated.
  2. Any credible report of misconduct will result in an investigation and may lead to immediate removal from the platform.

A.3 Weapons and Violence

  1. Drivers are prohibited from carrying firearms or weapons of any kind while providing transportation services through the Recovery Rides platform.
  2. Threats or acts of violence will result in permanent termination.

A.4 Confidentiality and Boundaries

  1. Drivers are strictly prohibited from asking about, documenting, or disclosing any rider’s medical condition, treatment, or destination purpose.
  2. Conversations with passengers must remain professional and respectful.

A.5 Reporting Dangerous Situations

  1. Drivers are strongly encouraged and expected to communicate to facility staff if they observe or sense any behavior, language, or condition that may pose a threat to the safety of the rider, themselves, or others.
  2. Such disclosures must remain limited to concerns of safety only.

A.6 Agreement to Policy

  1. By signing up for the Recovery Rides Driver App, all drivers affirm and accept the terms of this Zero Tolerance Policy in full.
  2. Drivers may not claim ignorance of the policy; it is displayed here in its entirety.

SECTION B: PLATFORM ACCESS, DRIVER STATUS & CONTRACTOR INDEPENDENCE

B.1 Platform Definition

Recovery Rides is a Peer-to-Customer (P2C) transportation technology platform specifically designed to serve a sensitive, recovery-oriented population. The platform acts as a facilitator between independent transportation providers (drivers) and individuals or treatment centers requiring reliable, consistent, and supportive transportation services. Drivers understand that they are part of a broader mission-driven network and that this platform is not a conventional logistics service. Instead, it serves a purpose distinct from that of any gig-based or generalized transport app.

B.2 Contractor Classification

  1. Drivers acknowledge and accept that they are independent contractors, not employees, of Recovery Rides LLC. This status governs the nature of the relationship in full, including payment structure, tax liability, and legal obligations.
  2. Drivers are solely responsible for maintaining compliance with federal, state, and local licensing, registration, insurance, tax, and employment laws, and any breach or neglect of these requirements is at the sole risk of the driver.
  3. Recovery Rides does not provide legal, financial, or operational guidance beyond platform-related matters and bears no liability for contractor misclassification or misrepresentation in their respective jurisdictions.

B.3 Local Law Compliance

  1. All drivers must independently research and remain current with the specific laws and insurance regulations applicable in the region in which they operate.
  2. This includes but is not limited to commercial licensing requirements, ride-for-hire statutes, vehicle inspection rules, and local ordinances related to recovery or medical transport.
  3. Recovery Rides assumes no responsibility for ensuring compliance and shall not be held liable for any penalties, fees, or infractions incurred by drivers operating unlawfully or negligently.

B.4 Insurance Responsibilities

  1. It is the driver’s sole duty to obtain, carry, and maintain adequate and lawful vehicle insurance that permits commercial use, as required by their region.
  2. Recovery Rides LLC is not an insurer and does not extend insurance coverage, protection, or reimbursement to drivers, their passengers, or their vehicles under any circumstance.
  3. Any insurance-related incidents must be handled directly by the driver and their insurance provider. Failure to carry adequate insurance is a breach of this policy and grounds for removal from the platform.

B.5 Background Checks & Records

  1. Drivers consent to a comprehensive background screening prior to approval. Recovery Rides may review national criminal history, driving records, and vehicle reports.
  2. Recovery Rides also reserves the right to conduct periodic rechecks for liability assurance, particularly if new concerns, complaints, or red flags arise.
  3. Drivers must promptly report to Recovery Rides any legal developments, including new criminal charges, driving infractions, license suspensions, arrests, or investigations that could compromise passenger safety or platform integrity.

SECTION C: STRATEGIC DISTINCTION – NOT A RIDESHARE COMPANY

C.1 Nature of Service

  1. Recovery Rides is not a rideshare company. We do not operate under the principles of gig economy transportation, nor do we position ourselves as a peer competitor to companies like Uber or Lyft.
  2. The Recovery Rides platform is exclusively mission-driven. The emphasis is on safe, respectful, and purpose-aligned transport tailored to individuals in recovery, rather than mass-market convenience or profit-driven volume.

C.2 P2C Model (Peer-to-Customer)

  1. Our Peer-to-Customer model ensures that connections between drivers and customers are based on availability, proximity, and shared mission alignment rather than rider competition, surge pricing, or open-market bidding.
  2. Drivers operating within Recovery Rides agree to perform transportation services in good faith, uphold the values of recovery support, and act with empathy, punctuality, and discretion at all times.
  3. Drivers must not treat this platform as transactional but instead approach each ride with care for the population served and the treatment outcomes being supported.

C.3 Recovery-Focused Values

  1. All drivers represent Recovery Rides’ values: dignity, trust, safety, and respect. Recovery Rides is more than a logistics solution; it is a partner to treatment providers, a safeguard to passengers, and a community resource.
  2. Drivers must embody those principles in both speech and action. Violations of these values, whether or not they constitute technical policy infractions, may still result in review and deactivation.

SECTION D: PAYMENT STRUCTURE AND STRIPE PARTNER REQUIREMENT

D.1 Payment Methodology

  1. Recovery Rides processes all ride transactions through its integrated third-party payment processor, Stripe. Drivers are not paid directly by Recovery Rides; rather, their compensation is issued by Stripe on behalf of Recovery Rides.
  2. Stripe distributes driver earnings based on the fare split percentage (currently 70%) calculated from the total fare for each completed ride.
  3. Tips added by customers in-app are distributed at 100% to the driver and are not subject to platform fees or redistribution.

D.2 Stripe Account Setup Requirement

  1. In order to receive earnings from rides, drivers must successfully complete the Stripe account onboarding process.
  2. Drivers are responsible for entering and maintaining accurate information (including name, SSN or tax ID, and bank account details) as required by Stripe.
  3. Until this setup is complete and approved, Recovery Rides cannot release earnings, nor can Stripe issue any payouts.

D.3 1099 Status and End-of-Year Filing

  1. All drivers are considered 1099 independent contractors and are responsible for managing their own tax filings and liabilities.
  2. Stripe will issue a 1099 form annually to all eligible drivers based on total earnings processed through the platform.
  3. By accepting these terms, drivers acknowledge they are responsible for any tax obligations that result from their use of the Recovery Rides platform.

SECTION E: GOVERNING LAW AND DISPUTE RESOLUTION

E.1 Jurisdiction Agreement

  1. By agreeing to this document and participating in the Recovery Rides platform, drivers consent that any legal claim, dispute, or action arising out of or related to their use of the platform shall be resolved exclusively within the jurisdiction of the Delaware Court of Chancery.
  2. This applies to all forms of legal resolution, including but not limited to civil litigation, injunctive relief, arbitration, or contract enforcement.
  3. Drivers waive any right to claim jurisdiction elsewhere or initiate proceedings in any alternative forum.
